Dear Ms. Ceroalo:

On behalf of the New York Legal Assistance Group (NYLAG) and its LGBTQ Law Project, we offer the following comments on the proposed amendments to New York’s Medicaid program which will remove the current exclusion on transgender health care.

We applaud Governor Cuomo and the New York State Department of Health for proposing an amendment to 18 N.Y.C.R.R. 505.2(1),  Transgender Related Care and Services, which will end a 16-year-old categorical exclusion on transgender healthcare under New York’s Medicaid program. We believe removal of this exclusion will create more comprehensive healthcare access to some of New York’s most vulnerable communities. The proposed change will also bring New York in line with other progressive states that have recently changed their regulations to be inclusive of transgender and gender non-conforming communities.
