NYLAG, through it’s Evelyn Frank Legal Resource Program, has expressed grave concerns about how the NYS Medicaid Program will implement various cuts enacted as part of the NYS FY 20-21 Budget. The cuts will go into effect in 2021.
- See NYLAG’s comments urging that the new “Lookback and Transfer Penalties” be implemented fairly in a way that does not delay approval for Medicaid. The new lookback will be required for people newly applying for Medicaid to receive home care services or the Assisted Living Program after April 1, 2021, unless it is further delayed. - Click here for comments warning about huge delays and other problems that are likely when new nursing and medical assessments will be required to obtain home care from Managed Long Term Care, other Medicaid managed care plans, and local Medicaid offices. The comments on the proposed State regulations also warn that the new stricter standards to qualify for Medicaid home care will discriminate against people with various cognitive, vision, mental, and other impairments.
