Immigrants, including kids, aren’t guaranteed a lawyer.

Under U.S. law, immigrants, including children, facing deportation don’t have the right to a court-appointed lawyer to help defend them from deportation. Yet, an immigrant without an attorney in immigration court is very unlikely to be able to stay in the U.S. and obtain legal status.

Current immigration law and policy are ever-changing. And immigrants are under constant attack.

Under President Trump, immigrants are a target. Now more than ever, Immigration lawyers with deep expertise are needed. NYLAG fills that role.

In 2018, NYLAG co-authored New York’s Standby Guardianship law to include immigration enforcement. A standby guardian is a person who can act as a guardian when a “triggering event” has occurred—in this case, if the child’s parent has been detained or deported by ICE.
