For many years, NYLAG’s Immigrant Protection Unit (IPU) has worked closely with New York’s community of immigrants from the former Soviet Union, including Ukraine. With an escalating humanitarian emergency following Russia’s invasion of Ukraine, we have harnessed our language capacity, deep immigration knowledge, and partnerships with community-based organizations on the ground to serve Ukrainian nationals with urgent immigration needs.
For Ukrainian nationals in the United States, we provide:
- Answers to legal questions about Temporary Protected Status (TPS) and other forms of immigration relief that may be available, including asylum
- Legal services to Ukrainian nationals in deportation (removal) proceedings
- Advice and assistance extending stays on visitor (B-1/B-2) visas
- Resources on legal options through consultations, flyers, and presentations in the most impacted communities
- Other legal assistance to Ukrainian nationals who cannot return home
For those seeking to be reunited with Ukrainian family abroad, we provide:
- Advice and assistance on reunification with loved ones impacted by the war
- Up-to-date information and advice on an evolving crisis
Temporary Protected Status (TPS): What to Know
The U.S. government has released the application for Ukrainian TPS and as of April 19, 2022, you can apply for Ukrainian TPS.
What is TPS?
- Those who are granted TPS are given permission by the United States government to legally reside and work in the U.S. for a designated period due to conditions in that country that prevent its nationals from safely returning.
- TPS is not an amnesty, and it is not a pathway to a green card or citizenship.
You may be eligible for Ukrainian TPS if you meet ALL of the following criteria:
- You are a national of the Ukraine; and
- You were in the United States on April 11, 2022 and have continued to reside in the United States since April 19, 2022.
If you have ever been arrested, convicted of a crime, and/or had any encounter with the U.S. Department of Homeland Security, it may affect your eligibility for TPS. Consult with an immigration attorney.
